Agreement to Terms
By accessing or using Caliper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Description of Service
Caliper is a web-based tool that helps contractors create material estimates and generate professional PDF quotes for fencing and flooring projects. The Service includes calculators, quote generation, and quote management features.
Account Responsibilities
When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
You must be at least 18 years old to use the Service.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use automated tools to access the Service without permission
- Resell or redistribute the Service without authorization
Subscription and Payments
Caliper offers both free and paid subscription tiers:
- Free tier: Access to calculators and on-screen estimates
- Paid tiers: PDF quote generation, branding, and additional features
Paid subscriptions are billed monthly through Stripe. You can cancel at any time, and your subscription will remain active until the end of the billing period. Refunds are not provided for partial months.
Free Trial
We may offer free trials of paid features. At the end of the trial, you will be charged for the subscription unless you cancel before the trial ends. We will notify you before the trial expires.
Your Content
You retain ownership of all content you create using the Service, including quotes, client information, and company details. By using the Service, you grant us a limited license to store and process this content solely to provide the Service to you.
Accuracy of Calculations
While we strive to provide accurate material calculations, the estimates generated by Caliper are intended as guides only. You are responsible for verifying all calculations and quantities before purchasing materials or providing quotes to clients. We are not liable for any losses resulting from reliance on our calculations.
Limitation of Liability
To the maximum extent permitted by law, Caliper and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
Termination
We may suspend or terminate your account if you violate these Terms. You may also delete your account at any time through the Settings page. Upon termination, your right to use the Service will cease, and we may delete your data according to our Privacy Policy.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through a notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.
